1. About JerkCall

These Terms of Service govern your use of JerkCall and its website, applications, video-chat functionality, accounts, subscriptions and related services. By creating an account or using JerkCall, you agree to these Terms. If you do not agree, do not use the service.

JerkCall is an adults-only service. You must be at least 18 years old to create an account or use any interactive feature. We may require age verification where appropriate and may suspend or terminate accounts where age information cannot be reasonably verified.

2. Eligibility and accounts

You are responsible for providing accurate account information and for keeping your login credentials secure. You must not create an account for another person, sell or transfer your account, or maintain multiple accounts for the purpose of evading a restriction or enforcement action.

You are responsible for activity occurring through your account. Contact us promptly if you believe your account has been accessed without permission.

3. Acceptable use

You agree not to use JerkCall to:

• harass, threaten, stalk, intimidate, blackmail or deliberately distress another person;
• share or request sexual content involving minors or facilitate exploitation of any person;
• engage in non-consensual sexual conduct, sexual coercion or sexual extortion;
• publish or distribute another person's private information without permission;
• impersonate another person or falsely claim an affiliation with someone;
• commit fraud, scams, phishing, payment abuse or other unlawful activity;
• upload malware, interfere with the service, probe security controls or abuse technical vulnerabilities;
• record, screenshot, redistribute or commercially exploit another person's video or personal information in violation of applicable law or their rights;
• circumvent bans, age controls, technical limits or other safety measures; or
• use automated systems, bots or scraping to collect information from JerkCall without written permission.

4. Random video chat

JerkCall connects users based on available matching information. We do not guarantee that a match will always be available, that a particular person will be matched with you, or that another user will behave appropriately.

Video conversations are initiated between users. Do not share passwords, payment credentials, home addresses, financial information or other sensitive information with strangers. If a conversation makes you uncomfortable, leave it and use the available reporting tools.

5. User content and reports

You remain responsible for content and information you submit through JerkCall. You grant JerkCall only the permissions reasonably necessary to host, process and display that content for operating and securing the service.

We may review reports, account information and other relevant information to enforce these Terms, investigate abuse, protect users and comply with legal obligations. We may remove content or restrict access when reasonably necessary.

6. Safety and enforcement

We may warn, restrict, suspend or permanently terminate accounts that violate these Terms, the Community Guidelines or applicable law. We may also take action where necessary to protect users, investigate suspected fraud or abuse, or comply with a lawful request.

Nothing in these Terms limits rights or remedies that cannot legally be excluded or limited under applicable consumer or other mandatory law.

7. Subscriptions and payments

If JerkCall offers paid features, the price, billing period, renewal terms and cancellation conditions will be shown before purchase. A paid feature may be provided by a third-party payment provider, whose terms may also apply.

Where applicable law gives you a right of withdrawal or other consumer protection, those rights apply. Digital-service rules may affect withdrawal rights where service performance begins with your express request and acknowledgement, to the extent permitted by law.

8. Intellectual property

JerkCall, its branding, software, design and original materials are protected by applicable intellectual-property laws. You may use the service only for its intended purpose. You may not copy, modify, distribute or commercially exploit JerkCall materials except where permitted by law or with written permission.

9. Availability and third parties

We aim to keep JerkCall available, but the service may occasionally be unavailable because of maintenance, outages, security incidents, network problems or third-party services. We do not guarantee uninterrupted availability.

10. Liability

To the maximum extent permitted by applicable law, JerkCall is not responsible for the independent conduct of users, information users voluntarily exchange, or interruptions outside our reasonable control. Nothing in these Terms excludes or limits liability where doing so would be unlawful, including mandatory consumer rights or liability that cannot legally be excluded.

11. Changes

We may update these Terms when the service, law or safety requirements change. Material changes will be communicated through reasonable means. Continued use after an updated version becomes effective means you accept the updated Terms, subject to any rights you have under applicable law.

12. Governing law

These Terms are intended to operate subject to the mandatory laws and consumer protections applicable to you. Nothing here is intended to deprive consumers of mandatory rights under the law of their country of residence.
