1. Overview
JerkCall respects the intellectual property rights of others and expects everyone who uses the site to do the same. We respond to clear notices of alleged copyright infringement in line with the U.S. Digital Millennium Copyright Act (DMCA) and other applicable laws.
Some content on JerkCall, such as live performer previews, images and banners, is provided by partner services. Where content comes from a partner, we will remove or disable it on JerkCall and, where appropriate, forward your notice to that partner.
2. Filing a takedown notice
If you believe content on JerkCall infringes your copyright, send a written notice to our copyright contact (see section 7). To be valid, your notice must include:
- Your physical or electronic signature, as the copyright owner or a person authorised to act on their behalf.
- A description of the copyrighted work you believe has been infringed.
- The exact URL(s) on JerkCall where the material appears, so we can locate it.
- Your name, postal address, telephone number and email address.
- A statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent or the law.
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorised to act on the owner's behalf.
Notices that are missing required information may not be acted on until they are complete.
3. What happens next
When we receive a valid notice, we will remove or disable access to the material concerned promptly. Where possible, we will let the person who provided the material know that it was removed, so they can respond with a counter-notice.
4. Counter-notices
If you believe material was removed by mistake or misidentification, you may send a counter-notice to our copyright contact. It must include:
- Your physical or electronic signature.
- A description of the material that was removed and where it appeared before removal.
- A statement, under penalty of perjury, that you have a good-faith belief that the material was removed as a result of mistake or misidentification.
- Your name, address and telephone number, and a statement that you consent to the jurisdiction of the appropriate court and will accept service of process from the person who filed the original notice.
If we receive a valid counter-notice, we may restore the material unless the original complainant informs us that they have filed a court action to stop the infringement.
5. Repeat infringers
We will stop working with, or remove content from, sources that are repeatedly the subject of valid infringement notices.
6. False claims
Please make sure material actually infringes your rights before filing a notice. Knowingly misrepresenting that material is infringing, or that it was removed by mistake, may make you liable for damages under Section 512(f) of the DMCA.
7. Copyright contact
Send takedown notices and counter-notices by email to jerkcall@gmail.com with "DMCA notice" in the subject line.
